CONSENT AND AGREEMENT FOR ELECTRONIC DELIVERY OF BANK STATEMENTS

Welcome to Two River Community Bank’s E-Mail statement delivery service.  Our goal is to provide you with an easy and convenient way to receive your monthly bank statement.

We need your consent to begin sending your bank statement to you electronically.  Please review the information below prior to giving your consent.  By agreeing to have your bank statement sent electronically, you also agree to notify Two River Community Bank, immediately in writing at the address listed at the end of this agreement, of any changes in your email address or any errors or complications relating to the electronic receipt of your bank statement.  

You agree that in the event of any error appearing in the Statement of account, you will notify TRCB immediately by email using TRCB-Online secure email.  If no error is reported within sixty (60) days from the statement date, you agree that the Statement of Account will be deemed to be accurate.  The same terms apply with respect to electronically delivered bank statements as for those delivered in paper form and the deposit agreements and disclosures that you previously received from Two River Community Bank remain in effect.

In order to use the Service, you must be a TRCB-Online Internet Banking customer. You must accept the terms of the E-Sign Act in addition to this agreement to become a registered user of the Service.

If you elect to receive your statement by electronic delivery, Two River Community Bank will no longer send you a paper statement through the U. S. mail.  Your periodic statement will be available to you via TRCB-Online on your scheduled statement date.  Your ongoing consent to receive subsequent account statements electronically is voluntary and may be withdrawn at any time. 

You may withdraw consent by telephone, by sending us an e-mail at onlinesupport@tworiverbank.com, or by sending a written notice to the address at the end of this agreement.  We will not charge any fee for discontinuing this service.  Statements will then be mailed to you at the address on file at no extra charge.

Your consent, which will be given by selecting submit to this Online Consent and Agreement, will authorize Two River Community Bank to forward to you electronically your periodic bank statement and any other disclosures that Two River Community Bank might otherwise have sent to you with your paper bank statement, such as other required disclosures relating to your accounts.

Any account holder can enroll accounts with joint ownership for the Service.  Enrollment of the ‘primary’ statement account will also enroll all accounts normally associated with that account statement.  Once enrolled, these accounts will no longer appear on any account owner’s paper statement.  The account statement will be available for viewing to all owners of the account who are enrolled in TRCB-Online regardless of which owner enrolled for the Service.

It is necessary to have Adobe Acrobat Reader 7.0 or above installed on your PC to view the statement.  You can obtain a free copy of Adobe Acrobat Reader by visiting www.adobe.com .  Acrobat Reader is available by clicking the “downloads” link.  You can retain your e-statement by either printing a hard copy or saving an electronic copy.

You agree that in no event will Two River Community Bank be liable for any technical, hardware or software failure of any kind, any interruption in the availability of our service, any delay in operation or transmission, any incomplete transmission, computer virus, loss of data, or other similar loss.

The Bank may change, suspend or eliminate all or any aspect of this delivery service upon notice to you.

You agree that any claim or controversy relating to this Consent and Agreement will be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.  You agree that any claim or controversy you may have will be arbitrated on an individual basis and will not be considered consolidated in any arbitration with any claim or controversy of any other party.  You agree that the arbitration will be conducted in the city in which the Bank’s main office is located and any court having proper jurisdiction may enforce that judgment on the arbitration award.

You agree that this Consent and Agreement is governed by the laws of the State of New Jersey, excluding any application of conflicts of laws, rules or principles.  You agree that the sole jurisdiction and venue for any litigation arising from your use of our service shall be an appropriate federal or state court located in New Jersey.

I have read and agree to the above Agreement for Electronic Statement Delivery.  This Agreement is binding for all accounts requested the ‘primary’ statement account will also enroll all accounts normally associated with that account statement and can be withdrawn by sending a written request to Two River Community Bank.  Any request to terminate the electronic delivery of account statements and disclosures, and reinstate the delivery of paper account statements and disclosures, will become effective within (10) days after the actual receipt of the written request by Two River Community Bank.
